Terms of Service

These terms apply when you use the Trade Binder app or this website. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
What Trade Binder is
Trade Binder is a tool for pricing and recording trades of collectible cards. It holds both sides of a deal at once, what you are sending and what you are receiving, works out what each side is worth, and keeps a record of it. It is built for collectors trading card for card and for vendors buying and selling at a table, and those are the same calculation with different rates.
Trade Binder is a record keeping and calculation tool. It is not a party to any trade, not a marketplace, not an escrow service, and not a payment processor.
Your account
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you need a parent or guardian's permission.
You are responsible for keeping your login details secure and for everything that happens under your account. Tell us promptly if you think someone else has access to it.
Do not impersonate another person, create an account for someone else without their permission, or create a new account to get around a suspension.
Trades are between you and the other person
This is the most important section, so it is stated plainly.
Any trade you arrange using Trade Binder is an agreement between you and the other person, not with us. We do not verify that anyone will honour a deal, that cards are authentic, that a condition or grade is accurately described, or that the other person is who they claim to be. We do not take custody of cards and we do not handle money.
A deal is settled when both sides confirm it in the app. That confirmation records what was agreed. It does not move cards or money, and it is not a promise by us that either side will deliver.
Meeting in person and shipping
If you meet someone in person to complete a trade, you do so at your own risk. Choose a public place, such as a card show or a local game store, and use your judgement about who you deal with.
If you ship cards to complete a trade, you and the other person arrange the shipping between yourselves. Packaging, carrier, insurance, tracking and who sends first are yours to agree. We are not responsible for cards lost, damaged or never sent.
In both cases we have no ability to intervene, recover cards or money, or decide a dispute about what was agreed.
Vendors and rates
A vendor can set their own rates: what they pay for cards, and what they sell them for, as a share of market value, with overrides for particular cards. Trade Binder applies the rates the vendor sets. We do not set, recommend or approve anyone's rates, and a vendor is responsible for the prices they offer.
Using Trade Binder does not make us part of any vendor's business. Vendors are responsible for their own obligations, including any taxes, licences and consumer protection rules that apply to them.
Prices and valuations
Prices shown in the app are estimates, worked out from third party market data such as recent sales. They are not appraisals, and they are not a guarantee of what any card will sell or trade for. Prices can be out of date or wrong, especially for cards that rarely sell. Decisions you make based on them are yours.
Listing for trade and wantlist matches
When you mark a card for trade, other collectors can see it, within your collection visibility setting, and it can appear in their wantlist matches. They may request a trade with you. You are never obliged to accept.
Wantlist matches are suggestions based on the cards people have recorded. We do not promise that a matched card is still available, or that it is exactly as described.
Credibility and reports
Your profile shows a credibility score and a trader level, worked out from your activity in the app, such as completed and abandoned deals. They are a summary of that activity, not an endorsement or a guarantee of anyone's honesty.
If someone treats you unfairly, report them in the app. We review reports and may act on them, but we cannot promise any particular outcome.
Acceptable use
Do not use Trade Binder to:
- Defraud, deceive or harass another user
- Trade counterfeit, stolen or misrepresented cards
- Misdescribe a card's condition, grade or authenticity
- Upload photos that are not of the actual card you are offering
- Manipulate credibility scores, for example with fake deals or accounts
- Scrape, bulk extract or resell data from the service
- Interfere with the service or try to access accounts or data that are not yours
- Break any law that applies to you
We may suspend or remove an account that does any of these, or that receives credible reports of doing so.
Your content
You keep ownership of what you put into Trade Binder, including your collection records and photos. You give us permission to store it, show it to the people it is shared with under your settings, and use it to run the service.
You are responsible for the accuracy of what you record, and you must have the right to any photo you upload.
Our app and the cards we show
The Trade Binder app, name and design belong to us. You may use the app for your own trading, but you may not copy, modify or resell it.
Card names and card images shown in the app belong to their owners. Trade Binder is not affiliated with, endorsed by, or sponsored by Nintendo, Creatures Inc., GAME FREAK inc., or The Pokemon Company.
Features that are not built yet
We plan to add more to Trade Binder over time, which may include buying and selling cards outright, verified trader tiers, reporting tools for vendors, and help with high value trades. None of these exist yet. If we build any of them, they may come with additional terms, and we will ask you to agree before they apply to you.
Availability
The app is in active development. We do not promise that the service will be uninterrupted or free of errors, that data will never be lost, or that any particular feature will continue to exist. We may change or discontinue parts of it.
Ending your account
You can stop using Trade Binder at any time and ask us to delete your account. The Support page explains how, and the Privacy Policy explains what happens to your data.
We may suspend or close an account that breaks these terms, or where we need to in order to protect other users or comply with the law.
Disclaimers and liability
The service is provided as is and as available, without warranties of any kind, to the fullest extent the law allows.
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential damages, for lost profits, or for any loss arising from a trade, a meeting or a shipment arranged through the service. Nothing in these terms excludes liability that cannot legally be excluded, or takes away rights you have as a consumer under the law where you live.
Changes to these terms
We may update these terms. When we do, we will change the date at the top, and if a change is significant we will tell you in the app before it takes effect.
